Terms and Conditions of booking a class or event at Gymshark London, Regent Street.

GYMSHARK STUDIO TERMS AND CONDITIONS

PLEASE READ THESE TERMS CAREFULLY BEFORE COMPLETING YOUR BOOKING AND/OR USING

THE GYMSHARK STUDIO LOCATED AT 165 REGENT STREET, LONDON W1B 4AD (“Studio”).

WHO WE ARE. We are Gymshark Ltd a company incorporated and registered in England and Wales with company number 08130873 (“Gymshark”, “we”, “us”, “our”). Our main office is at GSHQ, Blythe Valley Park, 3 Central Boulevard, Solihull, B90 8AB, United Kingdom and our registered VAT number is GB152119636.

HOW TO CONTACT US. You can contact us via the support section on the Gymshark App (“App”) or in person.

HOW WE MAY CONTACT YOU. If we have to contact you (e.g. to confirm, re-schedule or cancel your booking and invite you to events or classes), we will send an email to the email address you provided to us during the booking process and/or via App notification.

WHEN YOU BOOK A PLACE TO ATTEND THE STUDIO, WHETHER TO WORKOUT, ATTEND A CLASS OR AN EVENT, YOU ACKNOWLEDGE AND AGREE THAT:

Your booking

  • Your access to and use of the Studio and participation in the selected activity will at all times be subject to these Terms. If you do not want to be bound by these Terms, please do not book or attend the Studio, class, workout or event.

  • Your booking, once completed and confirmed by us, will allow you to access and use the Studio and participate in the activity selected during the booking process. Your booking is not complete until you have received a booking confirmation. Please make sure you receive a booking confirmation before you attend. If you do not receive confirmation, please contact us. If you can’t make a class, please cancel it on the App so it can be offered to anyone on our wait list! Our Pro’s will monitor class attendance and if you are consistently late or absent, we may have to suspend your access to the Studio

  • All bookings, classes and events are offered by us subject to availability. The Studio timetable, and availability of classes, events and Pro’s may change from time to time. We also reserve the right to cancel or reschedule classes and events at any time in our sole discretion. We will use reasonable endeavours to notify you of changes to your booking as far in advance as we can, however this may not always be possible, for example, in the event of a cause beyond our reasonable control (including but not limited to acts of God, flood, earthquake or other natural disaster, epidemic or pandemic, terrorist attack, civil war, civil commotion or riots, any law or any action taken by a government or public authority, collapse of buildings, fire, explosion or accident, and/or non-performance by suppliers or subcontractors). We accept no responsibility to you for amending, rescheduling and/or cancelling bookings.

  • Your booking is of nil value and is for your own personal use only. You will not give or sell your booking to anyone else. Unfortunately you can’t make a booking on behalf of anyone else!

  • Our Pro’s and staff will monitor compliance with these Terms. Please treat them with respect always. We don’t want to have to come down heavy on you, but if you don’t comply with these Terms or if you act in a manner which is abusive, threatening and/or not consistent with our values, we may refuse your entry to the Studio or ask you to leave the Studio and your future access to the Studio may be permanently suspended

Keep safe & sound

  • It is a condition of participation in any class, workout or event at the Studio, that you complete our Before You Exercise Form (“BYE Form”), which is made available to you during the booking process via the App. You agree that the information you provide within your BYE Form is complete and accurate to the best of your knowledge and belief. If you have indicated any medical conditions within the BYE Form that may adversely affect your ability to safely undertake the selected activity, you agree to consult with your doctor or other qualified medical professional to clarify if it is safe for you to participate. If your health changes adversely in any way, you agree to seek and follow medical advice before attending and/or participating in the selected activity.

  • You will not attend the Studio or participate in any classes, workouts or events if you are under the influence of alcohol or non-prescription drugs.

  • You will act responsibly and sensibly and will at all times comply with these Terms and the Studio Rules referred to below, any other instructions issued by us and/or our representatives, and any health, safety and security policies and procedures applicable at the Studio.

  • Our Pro’s at the Studio are there to help and coach you. Our Pro’s, staff, contractors, athletes, influencers and ambassadors may express views and opinions during classes, workouts and events based on their own personal experiences, however they will not provide medical or health advice and they are not qualified to express an opinion that you are fit to safely participate in any classes, workouts and/or events.

  • Information provided to you during a class, workout or event is not a substitute for seeking professional health advice; if you have concerns about your own mental or physical health or that of someone known to you then you should always consult your GP, doctor or other qualified healthcare professional.

Respect privacy – filming & photography

  • There will be times when you are not able to use mobile phones, cameras and other recording equipment. You will not use such equipment unless you are allowed to do so, and any use will be for your personal and private use. You will respect the privacy of others in attendance – not everyone wants to be filmed or photographed. The Studio provides a space for us to improve the health and fitness of our community, carry out product testing, conduct photo shoots and/or events. You agree that if any person is to be clearly visible or in the forefront of your photograph, video or other media, you will obtain their permission in advance.

  • We may from time to time conduct filming and/or take photographs (“Footage”) of the Studio, the Gymshark Store, classes, workouts and events including Footage of attendees and participants. If you have provided your consent to be captured in any such Footage as part of the booking process, then you acknowledge and agree that we are entitled to use Footage of you, for our own purposes (including, but not limited to, use on our website, email marketing, social media pages and other marketing materials, internal and/or external corporate presentations and enforcement action) and you do not object to us storing copies of the Footage or your contact details in case we need to get in touch with you. If you did not provide your consent, that’s fine too - it will not affect your ability to attend the Studio and we will take appropriate measures to ensure that you are not included in the Footage.

  • Full details of your rights in relation to the information we collect, how we use it, who we share it with, how long we keep it and how to end any use of it by us are set out in our Privacy Notice which you can find https://uk.gymshark.com/pages/gymshark-privacy-notice.     

Personal possessions

  • Lockers and open storage units are provided for storage of your personal possessions, which you may store in them at your own risk. We will not be responsible to you for any loss, damage or theft of any property you bring onto our premises.

Our responsibility to you

  • We don’t exclude or limit our responsibility to you where it is unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or contractors.

We will have no responsibility to you for any:

  • travel, accommodation and subsistence costs;

  • special, consequential and/or indirect loss or damage (i.e. any loss or damage that is not foreseeable);

  • loss of salary and/or enjoyment;

  • loss and/or damage to equipment and/or personal belongings (including theft); and/or

  • acts and/or omissions of other people attending the Studio, the Gymshark Store and/or participating in any classes, workouts and/or events at the Studio or the Gymshark Store.

  • Each of the provisions in these Terms apply to the maximum extent permitted by applicable law, and the exclusions and/or limitations will be deemed to be worded to take effect to the maximum extent permitted by applicable law.

Changes to these Terms

  • We can make changes to these Terms from time to time – if we do, you’ll be notified via email or the App and the changes will be effective immediately. You can also get a copy of these Terms from a member of our team at the Gymshark Store and the document/waivers section for GSLDN on the App.

  • We may transfer our responsibilities to you under these Terms to another member of the Gymshark Group at any time without notice to you.

Resolving disputes with us

  • Our Studio and/or Gymshark Store team will do their best to resolve any problems you have with us or our services.

  • You can go to court. These Terms are governed by English law and you can bring claims against us in the English courts.


STUDIO RULES - THE PRACTICAL STUFF

Attending classes & events

  • Make sure you have completed the BYE Form, booked your place via the App, and received your booking confirmation before you attend. For those of you who are super organised, classes may be booked up to 7 days in advance.

  • For classes, check in with one of our Pro’s when you arrive at the Studio.

  • Be on time – our Pro’s are entitled to prevent you taking part in a class if you are late. This is in place to prevent injury and to be mindful of the instructor and other participants in the class.

  • If you can’t make a class or event, tell us 24 hours in advance via the “My Bookings” section of the App to avoid a strike! If you get five strikes, a Pro will be in touch to check in and offer coaching, guidance and motivation.

What to wear?

  • Keep it real and dress appropriately for your activity – please keep your tops on!

  • Please don’t bring muddy training shoes into the Studio! Shoes must be clean and not open toe (e.g. flip flops, sandals). If you are asked to remove your shoes during your workout, please do!

Use of lockers – your property, your responsibility

  • Leave your valuables at home!

  • Lockers and open storage units are available for daily use only and you are welcome to bring your own padlock for the lockers. Padlocks left overnight will be removed and the contents of the locker emptied.

Play nicely – we are a family after all!

Don’t let your behaviour or conduct impact upon others enjoyment of the Studio – that means when you are in the Studio and surrounding areas, including the Gymshark Store generally:

  • Look after your stuff and keep the place tidy – if you notice something isn’t right or need help, let a member of staff know.

  • No bags of any kind on the floor (unless you have special authorisation)!

  • Your sweat is yours – no one else wants it so please wipe down all equipment after use.

  • We all like a bit of banter but not everyone will think you’re funny. Offensive or intimidating language or conduct will not be allowed!

  • No tripods or other filming equipment.

  • Don’t attend the Studio if you are under the influence of alcohol or non-prescription drugs, and don’t bring any alcohol or illegal substances onto the premises! We have zero tolerance to the use of performance enhancing drugs or supplements.

  • No smoking or vaping.

  • Bring beverages in sealed containers.

  • Please don’t bring your own food onto premises and/or consume food during classes, workouts or within the Studio generally. If you need a pick me up before or after a class or workout, food and beverages can be purchased and consumed in the designated areas within the Gymshark Store.

  • You may see athletes, influencers, and ambassadors at the Studio and/or the Gymshark Store. Please treat them with respect.

Keeping Safe & Sound

We want everyone to enjoy using the Studio and be able to participate in classes, workouts and events, but you have to look after yourself! The activities are physically challenging and carry with them risks that cannot be entirely eliminated. This includes the risk of personal injury. So you must:

  • Complete the BYE Form prior to attending the Studio for a workout or event – and make sure this is kept up to date. A Pro will be in touch with you if anything on your BYE Form needs to be discussed further.

  • Be aged 18 or over. Classes, workouts and/or events will only be open to participants under the age of 18 at our sole discretion, and subject to completion of a consent form signed by a parent or guardian prior to participation.

  • Be medically and physically fit and have not been advised not to participate in physical activity by a qualified medical professional. If your health or fitness changes adversely in any way, or you are unsure, please seek and follow medical advice before attending the Studio.

  • Act responsibly and sensibly at all times and follow any safety warnings or instructions displayed or given to you by a Pro, instructor or therapist.

  • Warm up and cool down sufficiently. If you experience faintness, dizziness, pain or shortness of breath at any time whilst exercising, you should stop immediately and seek medical advice;

  • Report any injuries you sustain whilst at the Studio to one of our Pro’s.

  • Enter and exit the Studio through the main entrance. Fire exits are clearly marked and must be kept clear at all times (don’t mess with the fire doors!).

  • Report any damaged or defective equipment to our Pro’s ASAP.
